War is not Over: Moeldoko's Democrats Continue to Court

Kemenkumham's rejection is based on the Democratic Party's statutes and bylaws

REPUBLIKA.CO.ID, JAKARTA -- The conflict in the Democrat Party between Agus Harimurti Yudhoyono and Moeldoko camp has not been resolved. Whereas the Indonesian Ministry of Law and Human Rights (Kemenkumham) has firmly rejected the results of the extraordinary congress (KLB) of the Democratic Party in Deli Serdang, Medan, North Sumatra, which appointed Moeldoko as chairman of the Democratic Party.

Menkumham Yasonna Laoly said the rejection was made following the failure to fulfill the administrative requirements for the holding of the KLB. "The government stated that the request for ratification of the KLB results in Deli Serdang on March 5, 2021 was rejected," said Yasonna in a virtual conference in Jakarta, Wednesday (31/3).

Kemenkumham's rejection is based on the Democratic Party's statutes and bylaws (AD/ART) which the government ratified in 2020. The Democrat KLB for Moeldoko's camp did not meet the requirements such as the requirements for representatives of the DPD and DPC. Also, there is no mandate from the chairman of the DPD and DPC in accordance with these statutes.

However, Chairman of the Honorary Board of the KLB Democratic Party, Max Sopacua, said they are ready to continue the fight to get his party's legality to court. Max admits that he remains optimistic that the court will grant the KLB Democrats' claim.

Max said that he was preparing all the material needed to win the lawsuit in this court.

He invited the panel of judges to carefully consider the evidence submitted by the KLB version of the Democrats. "What is clear is that we have prepared the materials that we will bring in accordance with the court's direction. And for later viewing by the judge," said Max, Friday (2/4).

Max is still keeping secret what material the Democrats on the KLB camp have prepared. "We cannot discuss the court material for now," continued the former member of the Indonesian Parliament.

Max said that the Democrats in the KLB camp did not only prepare material for the lawsuit in the form of documents. He gathered people who were deemed able to testify about the mistakes of the Democrats in the Cikeas camp.

Even though he lost at Kemenkumham, Max believes that the Democrats in the KLB camp will gain victory at the court stage. He is already reluctant to question the failure at the Kemenkumham stage.
