Parliament immunity not applied to corruption cases: KPK

REPUBLIKA.CO.ID, JAKARTA -- Spokesperson of Corruption Eradication Commission Febri Diansyah said, Parliamentary immunity does not applied to corruption cases. Therefore, members of House of Representatives allegedly involved incorruption cases could not hide behind Parliamentary immunity.

"It did not applied to suspects of corruption cases and people who have information on graft cases," he said on Tuesday (November 14).

Febri worried that people would assume impunity enjoyed by House members implicated in criminal cases.

"Do not let people assume there are people that above the law and they can not be examined or restricted to be examined. Moreover, in corruption cases," he stated.

Febri explained, Parliamentary immunity only applied to House of Representatives members in relation to their duty or statement.

Meanwhile, Novanto's lawyer thought otherwise. 

Frederich Yunadi, advised his client not to appear in the hearing on Monday (November 13) of e-ID card graft case for defendant Anang Sugiana Sudiharja.

He said, KPK does not have the rights to summons without permission from the president. 

"Article 20A of the Constitution 1945 stated House's members have the rights to speak, inquiry rights, rights to oversee and immunity. Immunity means members of the House are untouchable," Frederich said in Jakarta on Sunday (November 12).

In a letter to KPK, Setnov explained his absence. He used immunity rights as House's member. On the day of the summons, Setnov said he was on tour in his electoral district, East Nusa Tenggara.

Frederich assessed, KPK has violated the law by insisting to summon. On the other hand, he said, his client was obeying the law by not coming to the court.
